Welcome to 88 Timeline. These Terms of Service ("Terms") constitute a legal agreement between you ("User," "you," or "your") and 88 Timeline ("we," "us," or "our") regarding your use of our mobile application ("App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the App.

2. License to Use the App

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial purposes.

2.2 Restrictions

You agree not to:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Remove, alter, or obscure any proprietary notices (including copyright notices) on the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the App or related systems
• Use the App in any manner that could damage, disable, overburden, or impair our servers or networks
• Use the App to harass, abuse, or harm another person or entity

3. User Content

3.1 Your Content

The App allows you to create, upload, and store video content, tags, notes, and other materials ("User Content"). You retain all ownership rights to your User Content. All User Content is stored locally on your device and is not uploaded to our servers.

3.2 Responsibility for Content

You are solely responsible for your User Content and the consequences of creating, uploading, or storing it. You represent and warrant that:

• You own or have the necessary rights to all User Content you create or import
• Your User Content does not violate any laws or infringe upon the rights of any third party
• Your User Content does not contain any viruses, malware, or harmful code

3.3 Content Standards

While your content is stored locally and privately on your device, you agree not to use the App to create, store, or share content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Infringes on intellectual property rights or privacy rights of others
• Contains malicious software or code
• Violates any applicable local, state, national, or international law

4. App Features and Functionality

4.1 Video Recording and Storage

The App allows you to record and import videos of up to 8 seconds per day. All videos are stored locally on your device. We do not have access to your videos and do not store them on our servers.

4.2 Video Mashups

The App enables you to create video compilations ("mashups") from your stored videos. The quality and functionality of mashup creation depends on your device's processing capabilities and available storage.

4.3 Third-Party Services

The App may integrate with or provide links to third-party services (such as analytics providers, mapping services, or social media platforms). Your use of such third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

5. Device Permissions

To function properly, the App may request access to certain device features and data, including:

• Camera: To record videos
• Storage: To save and access videos on your device
• Notifications: To send daily recording reminders
• Calendar: To create and manage recording reminders
• Location: For navigation and mapping features (if applicable)

You can manage these permissions through your device settings at any time. Revoking certain permissions may limit the functionality of the App.

6. Intellectual Property Rights

6.1 Our Rights

The App and all its original content (excluding User Content), features, functionality, and design are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Trademarks

Our name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks or those of our affiliates or licensors. You may not use such marks without our prior written permission.

7. Updates and Modifications

7.1 App Updates

We may release updates, upgrades, or new features for the App from time to time. Some updates may be required for the App to function properly. You agree that we may automatically update the App on your device.

7.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms within the App or by other reasonable means. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or quality of any content or information obtained through the App

Your use of the App is at your sole risk. We do not warrant that the App will meet your requirements or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or the like that may be transmitted to or through the App by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the App
• The deletion, corruption, or failure to store any User Content maintained or transmitted through the App

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESSING OR USING THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless 88 Timeline, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the App in violation of any applicable law or regulation
• Your User Content or any content you create, upload, or store using the App
• Your violation of any rights of another person or entity

11. Data Backup and Loss

Since all User Content is stored locally on your device, you are solely responsible for backing up your data. We are not responsible for any loss, corruption, or deletion of your User Content. We strongly recommend that you:

• Regularly back up your device data
• Export important videos to secure storage locations
• Maintain copies of irreplaceable content outside the App

12. Termination

12.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. Uninstalling the App will delete all User Content stored locally on your device.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice, if we believe you have violated these Terms or for any other reason.

12.3 Effects of Termination

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Geographic Restrictions

The App is controlled and operated from our facilities. We make no representation that the App is appropriate or available for use in all locations. Those who access or use the App from other jurisdictions do so at their own volition and are entirely responsible for compliance with local law.

14. Dispute Resolution

14.1 Informal Resolution

If you have any dispute with us regarding the App, you agree to first contact us at [email protected] and attempt to resolve the dispute informally.

14.2 Arbitration

If we cannot resolve the dispute informally, any legal dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to its conflict of law provisions.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings, whether written or oral.

20. Age Restrictions

The App is not intended for use by children under the age of 13. By using the App, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

21. Export Controls

The App may be subject to export control laws and regulations. You agree not to export or re-export the App in violation of such laws or regulations.

22. Acknowledgment

By using the App, you acknowledge that you have read these Terms of Service, understand them, and agree to be bound by them. If you do not agree to these Terms, you must immediately cease using the App and uninstall it from your device.
